Terms and Conditions

1. Scope

The following terms and conditions (T&Cs) apply to all orders placed through our online shop. Our online shop is exclusively aimed at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly do not involve their commercial or self-employed professional activity. An entrepreneur is a natural or legal person or a legal partnership that, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

2. Contracting Parties, Conclusion of Contract, Correction Options

The purchase contract is concluded with Nico Panella.

By placing the products in the online shop, we make a binding offer for the conclusion of a contract for these items. You can initially add our products to the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided for this purpose in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order, you will receive a confirmation by email.

3. Language of the Contract, Contract Text Storage

The language available for the conclusion of the contract is German & English.

We save the contract text and send you the order data and our terms and conditions in text form. You can view the contract text in our customer login.

4. Delivery Conditions

In addition to the stated product prices, shipping costs will be added. You can find out more about the amount of shipping costs in the offers.

We only deliver by shipping. Unfortunately, a self-collection of the product is not possible.

5. Payment

According to the small business regulation $19 UStG, no sales tax is charged.
In our shop, the following payment methods are generally available to you:

Credit Card
By placing the order, you provide your credit card details, and the credit card company carries out an authorization check. After legitimation as the legitimate cardholder, the payment transaction is automatically carried out, and your card is charged.

PayPal
In the ordering process, you will be redirected to the website of the online provider PayPal. To be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately afterward. You will receive further information during the ordering process.

Sofort by klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have an online banking account with PIN/TAN procedure activated for participation in Sofort, legitimize yourself accordingly, and confirm the payment instruction to us. You will receive further information during the ordering process. The payment transaction will be carried out immediately afterward by Sofort, and your account will be debited.

Amazon Pay
In the ordering process, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online shop. To complete the ordering process via Amazon and pay the invoice amount, you must be registered there or first register and legitimize yourself with your access data. There you can choose the delivery address stored by Amazon and the payment method, confirm the use of your data by Amazon and the payment instructions to us. You will then be redirected to our online shop, where you can complete the ordering process.

Immediately after placing the order, we request Amazon to initiate the payment transaction. The payment transaction is carried out by Amazon automatically. You will receive further information during the ordering process.

6. Retention of Title

The goods remain our property until full payment has been made.

7. Warranty and Guarantees

Unless expressly agreed otherwise below, the statutory liability for defects shall apply.
For used goods: if the defect occurs after one year from delivery of the goods, the claims for defects are excluded. Defects that occur within one year from delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.
The aforementioned limitations and shortened limitation periods do not apply to claims based on damage caused by us, our legal representatives, or vicarious agents
• in case of injury to life, limb, or health
• in case of intentional or grossly negligent breach of duty, as well as fraudulent intent
• in case of breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
• within the framework of a guarantee promise, if agreed, or
• to the extent of the scope of the Product Liability Act.

8. Liability

For claims due to damages caused by us, our legal representatives, or vicarious agents, we shall always be liable without limitation
• in case of injury to life, limb, or health
• in case of intentional or grossly negligent breach of duty
• in case of warranty promises, if agreed, or
• to the extent of the scope of the Product Liability Act.

In case of breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives, or vicarious agents, the liability shall be limited to the amount of damages foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.
In all other respects, claims for damages are excluded.

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are not obligated or willing to participate in a dispute resolution procedure before a consumer arbitration board.
